May 1876: Another suck of the Orange |
In the Supreme Court of Judicature, on Saturday, before Lord Justice James, Mellish and Baggallay, the case of Mathias v. the Company of the Proprietors of the Wilts and Berks Canal Navigation came on.
This was an appeal by the plaintiff from the refusal of Vice Chancellor Malins to grant an injunction to restrain the defendant company from proceeding with a Bill which they are promoting in Parliament to carry out an agreement which they have entered into with a Mr Fox for the sale to him for £13,466 of their canal and some land and houses.
Mr Higgins, Q.C and Mr W.W. Karslake were heard in support of the appeal. Mr J Pearson Q.C and Mr W Barber for the company were not called on. Their Lordships dismissed the appeal with costs, characterising the appeal as an idle one.
